Guardianship and Conservatorship — California Attorneys

Fremont Legal Guardianship of a Minor Lawyers

While there are many areas of the law that let you act as your own attorney, you cannot set up a California conservatorship or guardianship without a lawyer. You must find an attorney you can trust to handle your case with care and protect your loved one.

At the Morgan Hill and Fremont law offices of Steven E. Springer, we advise clients who need help setting up a guardianship or conservatorship and represent their rights during any litigation that may arise. Contact us to discuss your options with an experienced California guardianship and conservatorship lawyer.

Guardianships

In California, you can petition the court to grant you or another adult with legal rights over a minor ("guardianship of a person") and/or a minor's significant estate ("guardianship of the minor's estate"). A guardianship usually lasts until the minor reaches adulthood (18 years). A person may bring a petition to terminate a guardianship at any time.

Conservatorships

If a person is incapable of taking proper care of himself or herself because of age or a disability, the court can appoint a conservatorship to have legal responsibilities over that person ("conservator of the person") and/or his or her financial estate ("conservator of the estate").

Conservatorships are a complicated, emotional and heavily contested area of law. We help clients set up, transfer or terminate conservatorships. We also handle litigation over conservatorships, including disputes involving allegations of elder abuse, breach of fiduciary duty and undue influence.

Guardianships and conservatorships are handled in California's probate court.
